Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you (“you” or “User”) and Demotic Design Inc. (“Company”, “we”, “us”, or “our”), located at 6349 Yonge St, North York, ON, Canada, governing your access to and use of the Adventurify mobile application and related websites, including https://adventurify.demoticdesign.com/ (together, the “Service”).

By downloading, creating an account, or using Adventurify, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use Adventurify. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Adventurify is a location-based exploration app. Features may include map fog reveal as you move, nearby quests and points of interest, travel and country journals, an Explorer Pass and related cosmetics or progression, sign posts and comments from other explorers, and account profiles. We may add, change, or remove features at any time without liability to you.

Adventurify is offered for personal, non-commercial use unless we agree otherwise in writing.

3. Accounts

You may create an account with email and password or through a supported sign-in provider such as Google. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You are responsible for all activity under your account.

You must not impersonate another person, use another user’s account, or create an account for anyone under 16. We may suspend or terminate accounts that violate these Terms, appear fraudulent, or pose a risk to other users or the Service.

You may delete your account from within the app where that feature is available, or by emailing support@demoticdesign.com. Deletion does not automatically remove content you posted publicly (such as sign posts) if we reasonably need to retain it for safety, legal, or operational reasons, as described in the Privacy Policy.

4. Location, camera, and device permissions

Certain features require access to your device location, including optional background location to continue revealing the map while the app is closed. Journal features may request access to your camera or photo library. You can grant or revoke these permissions in your device settings. If you refuse a permission, related features may not work.

Location data can be imprecise. Quests, map reveal, and nearby content are provided for entertainment and exploration and are not navigation, emergency, or safety services.

5. Safety while exploring

You agree to use Adventurify in a safe and lawful manner. You will not use the Service while driving or in any situation that requires your full attention. You are solely responsible for your conduct outdoors, including awareness of traffic, weather, terrain, private property, local laws, and personal safety.

Adventurify does not encourage trespassing, entering unsafe areas, or ignoring posted rules. Suggested places and quests may be inaccurate, closed, or inappropriate. You explore at your own risk.

6. User content

You may post, upload, or share content through the Service, including profiles, usernames, sign posts, comments, votes, journal entries, photos, and similar materials (“User Content”). You retain ownership of your User Content. You grant Demotic Design Inc. a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, distribute, and otherwise use User Content as needed to operate, improve, promote, and protect the Service.

You represent and warrant that:

• you own or have all rights needed to post the User Content and to grant the license above;
• your User Content does not infringe anyone’s intellectual property, privacy, or other rights;
• your User Content complies with these Terms and applicable law.

User Content may be visible to other users. We do not endorse User Content and are not responsible for it. We may remove, edit, or refuse any User Content at our discretion, including content that is unlawful, harassing, hateful, sexually explicit, spam, misleading, or that reveals others’ personal information.

7. Acceptable use

You agree not to:

• harass, threaten, defame, or harm other people, or post hate speech or illegal content;
• scrape, reverse engineer, interfere with, or overload the Service, or access it through unauthorized automated means;
• probe or exploit other users’ accounts, our systems, or third-party services used by Adventurify;
• manipulate quests, votes, ranks, or map progress through cheating, fake location, or similar abuse;
• use the Service to send spam, advertising, or unsolicited commercial messages;
• copy, sell, or commercially exploit the Service or our content without our written permission.

8. Our content and intellectual property

The Service, including software, design, maps styling, quests we provide, trademarks, logos, and documentation, is owned by Demotic Design Inc. or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the app on devices you own or control, solely for the purposes described in these Terms.

Map, place, and geographic data may come from third parties (for example, open mapping providers). Their licenses and attribution requirements apply in addition to these Terms.

9. Explorer Pass, virtual items, and purchases

Progression, cosmetics, ranks, and similar in-app items have no cash value, are licensed not sold, and may be modified or revoked. They are not redeemable for money except where required by law.

If paid features, subscriptions, or in-app purchases are offered, they are processed by Apple or Google according to their store terms. Taxes, billing, refunds, and cancellations for store purchases are handled by the applicable store unless the law requires us to assist.

10. Third-party services

The Service may rely on third parties, including Apple, Google, Appwrite, mapping and geocoding providers, and sign-in providers. Their terms and privacy policies govern your use of those services. We are not responsible for third-party sites, stores, or outages.

If you download Adventurify from the Apple App Store or Google Play, you also agree to the applicable store’s terms. Apple and Google are third-party beneficiaries of these Terms as they relate to your use of their stores, and may enforce those store-related provisions.

11. Privacy

Our collection and use of personal information is described in the Privacy Policy. By using the Service, you acknowledge that policy.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE, OR THAT QUESTS, MAPS, PLACES, OR OTHER USERS’ CONTENT ARE RELIABLE OR SAFE TO FOLLOW.

Some jurisdictions do not allow certain disclaimers. In those places, the disclaimers apply to the fullest extent permitted.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEMOTIC DESIGN INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) CAD $50.

These limits do not apply to liability that cannot be limited under the laws of Ontario, including liability for fraud or for death or personal injury caused by our negligence where such a limit is prohibited.

14. Indemnity

You will defend, indemnify, and hold harmless Demotic Design Inc. and its personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, your outdoor activities in connection with the Service, or your violation of these Terms or any law.

15. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

16. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use after the changes take effect constitutes acceptance. If you do not agree, stop using the Service and delete your account.

17. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Subject to applicable consumer-protection rights that cannot be waived, you agree that the courts of Ontario, sitting in Toronto, have exclusive jurisdiction over disputes arising from these Terms or the Service.

If you are a consumer in a jurisdiction that does not allow this choice of law or venue, those mandatory protections still apply.

18. General

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
